Terms of Service — Perch

These Terms are a binding agreement between you and Anthony Dragone, the developer of the Perch app ("Perch," "we," "us"). By downloading, signing in to, or using Perch, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.

1. Who can use Perch

You must be at least 13 (or your country's minimum age of digital consent) and able to form a binding contract.

2. What Perch is

A brain dump and note-taking app: capture thoughts, photos, drawings, voice recordings, brain dumps, and links. Supported AI features create summaries, brain-dump maps and reflections, possible next steps, collections, connections, and weekly overviews. Notes may resurface automatically or at a chosen time. Features may change as the app evolves; resurfacing, notifications, transcription, and AI results are not guaranteed to arrive at a particular time or identify every relevant detail.

3. Your account

Where available, capture can be used without an account. Sign in with Apple, Google, or email to use account backup and features that require authentication. You're responsible for keeping your account secure and for activity under it. Tell us promptly if it's compromised.

4. Your content

• You own your content.
• You grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, transcribe, summarize, and otherwise process your content SOLELY to provide and improve Perch for you — including sending it to our AI and infrastructure providers per the Privacy Policy. This license ends when you delete the content or account, except for already-processed data or limited backups.
• You're responsible for your content and confirm you have the right to store it. Saved links/media belong to their owners; your use is your responsibility.

5. Subscriptions, free trial, and billing

• Perch offers Free capture and optional Perch Pro features. Free brain dumps keep their recording and available transcript; ongoing full AI readings, automatic collections, connections, and weekly recaps are Pro features. Existing saved content remains available when a subscription ends.
• Eligible new users receive one included full brain-dump reading through onboarding, subject to account authentication, connectivity, supported transcription, and anti-abuse eligibility checks. This included reading is not a subscription and does not automatically charge you.
• Any subscription free trial or introductory offer is available only when shown in the purchase screen, with its eligibility, duration, price, and renewal terms. Creating an account does not by itself promise a new seven-day full-access trial. An earlier offer already granted remains subject to the terms under which it was offered.
• Pro features may be subject to reasonable usage limits, provider availability, and technical constraints. A subscription does not guarantee unlimited AI processing.
• If you subscribe, it auto-renews at the then-current price unless cancelled at least 24 hours before the period ends; your Apple ID is charged within 24 hours before each renewal.
• Apple processes payments (with RevenueCat for subscription management). We don't store card details.
• Manage or cancel in Settings → [your name] → Subscriptions. Cancelling stops future renewals.
• Refunds are handled by Apple under Apple's policies.
• We may change prices; changes apply to the next billing period with App Store-required notice.
• The exact title, length, and price are shown in the app before purchase.

6. AI features — what to expect

AI output can be incomplete or inaccurate; treat it as an assist, not truth. Perch is NOT a medical device and NOT medical, clinical, psychological, or professional advice. It does not diagnose, treat, or cure anything. Rely on a qualified professional for health decisions.

7. Acceptable use

Don't use Perch illegally; don't upload illegal/infringing/harmful content; don't break, overload, reverse-engineer, or scrape it; don't resell or commercially exploit it beyond personal use; don't misuse saved third-party content. We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

Perch — name, design, software, brand — is ours. You get a personal, non-transferable, revocable license to use the app as intended. No rights to our trademarks or code.

9. Third-party services

Perch relies on providers such as Apple, Google, Supabase, Anthropic, Supadata, ScrapeCreators, RevenueCat, PostHog, WishKit, and Resend. Earlier versions may also use Sentry; their terms may also apply. We're not responsible for third-party services or content you save from them.

10. Disclaimers

Perch is provided "as is" and "as available," without warranties of any kind. We don't warrant it will be uninterrupted, error-free, or that AI output will be accurate. Keep your own copies of anything you can't afford to lose.

11. Limitation of liability

To the fullest extent permitted by law, Anthony Dragone is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill. Total liability won't exceed the greater of what you paid us in the prior 12 months or USD $50. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

12. Indemnification

You'll indemnify Anthony Dragone from claims arising from your content, your use, or your violation of these Terms or the law.

13. Termination

Settings includes Delete all notes and Delete account. Deleting all notes keeps the account; deleting the account removes it and its associated content through the supported deletion flow. Cloud deletion requires connectivity. Deleting the Perch account does not cancel an Apple subscription; manage or cancel it separately through Apple. We may suspend or terminate access for violations or if we discontinue the app. Survival: content license for processed data, disclaimers, liability limits, indemnification, and governing law.

14. Changes to these Terms

We may update these Terms; material changes update the "Last updated" date and, where appropriate, are noted in the app. Continued use means you accept them.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Massachusetts, unless your local consumer-protection law gives you the right to a different forum.

16. Apple App Store terms

• This agreement is between you and Anthony Dragone only, not Apple. Apple isn't responsible for the app.
• License: non-transferable use on Apple-branded devices you own or control, per the App Store Usage Rules (including Family Sharing).
• Maintenance/support: Anthony Dragone is solely responsible; Apple has no support obligation.
• Warranty: if the app fails to conform, you may notify Apple for a refund of the price (if any); Apple has no other warranty obligation.
• Product claims: Anthony Dragone, not Apple, handles product-liability, regulatory, and consumer claims.
• IP: Anthony Dragone, not Apple, handles third-party IP-infringement claims.
• Legal compliance: you're not in an embargoed country or on a U.S. prohibited-parties list.
• Third-party beneficiary: Apple and its subsidiaries may enforce these Terms against you.
