Terms of Service — Perch

These Terms are a binding agreement between you and Anthony Dragone, the developer of the Perch app ("Perch," "we," "us"). By downloading, signing in to, or using Perch, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.

1. Who can use Perch

You must be at least 13 (or your country's minimum age of digital consent) and able to form a binding contract.

2. What Perch is

A note-taking app designed for ADHD brains: capture notes, photos, voice memos, and links, with AI that sorts, summarizes, connects, and resurfaces them. Features may change as the app evolves.

3. Your account

You sign in with Apple, Google, or email. You're responsible for keeping your account secure and for activity under it. Tell us promptly if it's compromised.

6. AI features — what to expect

AI output can be incomplete or inaccurate; treat it as an assist, not truth. Perch is NOT a medical device and NOT medical, clinical, psychological, or professional advice. It supports how ADHD brains work but does not diagnose, treat, or cure. Rely on a qualified professional for health decisions.

7. Acceptable use

Don't use Perch illegally; don't upload illegal/infringing/harmful content; don't break, overload, reverse-engineer, or scrape it; don't resell or commercially exploit it beyond personal use; don't misuse saved third-party content. We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

Perch — name, design, software, brand — is ours. You get a personal, non-transferable, revocable license to use the app as intended. No rights to our trademarks or code.

9. Third-party services

Perch relies on Apple, Google, Supabase, Anthropic, Supadata, ScrapeCreators, RevenueCat, PostHog, and Sentry; their terms may also apply. We're not responsible for third-party services or content you save from them.

10. Disclaimers

Perch is provided "as is" and "as available," without warranties of any kind. We don't warrant it will be uninterrupted, error-free, or that AI output will be accurate. Keep your own copies of anything you can't afford to lose.

11. Limitation of liability

To the fullest extent permitted by law, Anthony Dragone is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill. Total liability won't exceed the greater of what you paid us in the prior 12 months or USD $50. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

12. Indemnification

You'll indemnify Anthony Dragone from claims arising from your content, your use, or your violation of these Terms or the law.

13. Termination

You can delete your account anytime in Settings → Account. We may suspend or terminate access for violations or if we discontinue the app. Survival: content license for processed data, disclaimers, liability limits, indemnification, and governing law.

14. Changes to these Terms

We may update these Terms; material changes update the "Last updated" date and, where appropriate, are noted in the app. Continued use means you accept them.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Massachusetts, unless your local consumer-protection law gives you the right to a different forum.
